Please read these Terms of Use ("Terms") carefully before using VocaGuard ("the app", "we", "our"). By downloading, installing, or using VocaGuard, you agree to be bound by these Terms. If you do not agree, do not use the app.

1. Service Description

VocaGuard is a real-time scam call detection service. When call forwarding is enabled, incoming calls are routed through the VocaGuard server, which uses speech recognition and AI-based analysis to identify potential scam calls and alert you in real time.

3. Limitation of Liability and Release of Claims

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• VocaGuard and its developers, officers, employees, and affiliates shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the app, including but not limited to financial loss, identity theft, or any other harm resulting from a scam call that was not detected by the app.
• By using VocaGuard, you expressly acknowledge that scam calls may pass through undetected, and you release, waive, and discharge VocaGuard and its developers from any and all claims, demands, damages, or liability of any kind arising from or related to the failure of the app to detect any scam call.
• VocaGuard is provided "as is" and "as available" without warranty of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
• In no event shall our total liability to you exceed the amount you paid for the app subscription in the three (3) months preceding the event giving rise to the claim.

4. Call Monitoring and Recording Consent

When call forwarding is active, incoming calls are routed through the VocaGuard server for real-time audio analysis. By enabling call forwarding to VocaGuard, you acknowledge and agree to the following:

• You are enabling a third-party system to process the audio content of incoming calls made to your phone number.
• The calling party (the person calling you) is not notified that their call audio is being analysed for scam detection purposes.
• You are solely responsible for ensuring that your use of VocaGuard complies with all applicable laws in your jurisdiction regarding call monitoring, recording, and interception, including but not limited to two-party or all-party consent laws in states such as California, Illinois, Florida, and others.
• VocaGuard accepts no liability for any legal consequences arising from your failure to comply with applicable call monitoring laws.

5. Eligibility and Account

• VocaGuard may be used by anyone. Users under 18 should use the app with parental or guardian awareness and consent.
• You are responsible for maintaining the security of your account and for all activity that occurs under it.
• You agree to provide accurate information when registering your phone number with the service.

6. Subscription and Billing

• VocaGuard offers a paid monthly subscription. Pricing is displayed in the app and in the Google Play Store listing.
• Subscriptions are billed through Google Play. Billing, refunds, and cancellations are governed by Google Play's billing policies.
• A free trial period may be offered. If you do not cancel before the trial ends, your subscription will automatically renew and you will be charged.
• We reserve the right to change subscription pricing with reasonable advance notice.

7. Acceptable Use

You agree not to:

• Use VocaGuard for any unlawful purpose or in violation of any applicable law.
• Attempt to reverse-engineer, decompile, or tamper with the app or its server infrastructure.
• Use the app to monitor or intercept calls you are not a party to.
• Misuse the Family Guard Mode to send unsolicited alerts to contacts who have not consented to receive them.

8. Privacy

Your use of VocaGuard is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Service Availability

We do not guarantee that the service will be available at all times. The service may be interrupted for maintenance, server issues, or circumstances beyond our control. We are not liable for any loss or inconvenience resulting from service downtime.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected with a revised "Last updated" date. Continued use of the app after changes constitutes your acceptance of the updated Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Israel, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Israel.
